MPs pledge to implement NHRC recommendations

MPs of Nepal have emphasized on the effective implementation of the National Human Rights Commission recommendation for the protection and promotion of human rights in Nepal.

Amid the function organized in Kathmandu on Friday on the “Role of Parliamentary Committee for effective implementation of the report of National Human Rights Commission” by parliamentary committee on social justice and human right in collaboration with UNDP/Parliament Support Project MPs discussed on several ways and mechanism to implement it.

In the programme, Speaker of Parliament Onsari Gharti emphasized on the coordination among the implementing agencies of the State for the protection and promotion of human rights and end impunity. Dr. Jos Vandelaer, a.i. UN Resident Coordinator said that, “Effective implementation of NHRC report will institutionalize the democracy/democratic culture in the country”. “UN is very pleased to provide necessary supports for this initiative” he added.

Dr. Bipin Adhikari argued the importance of the independence of National Human Rights Institution while the courts have been failing to protect the human rights due to their procedural limitations. In the same vein, Dr. Rojnath Pandey, Secretary of the Committee stressed on the strong monitoring and evaluation, resources and coordination among human right related organization must for effective implementation. Chair of the committee, criticized that the report tabled for the first time in the parliament shows the status of the NRHC report failures of the state policy, strategy and mechanism for report implementation. Similarly, ex-chair of NHRC and chief justice Kedar Nath Upadhya argued about the limitations and opportunities of NHRC and committee in pessimistic way. Mr. Lokendra Mallik, chairman of the Commission on Investigation of Disappearance People showed his dissatisfaction against the limited provisions of TRC Act, at the same time, Dr. Madhavi Bhatta emphasized on the necessity of the amendment of TRC act to end impunity.

As per NHRC report 2015-2016, Out of total, 182 complaints have been reconciled based on the fact discovered upon monitoring and investigation whereas 26 cases have been recommended and 46 are not yet finalized. A total of 104 cases have been dismissed while the decision is made to keep 5 cases as pending. The Commission has recommended the compensation on 23 different cases. The recommendation for the compensation and legal action has not been improved this year even after the investigation conducted into the complaint of human rights violation and excess. The recommendation implemented so far are related to the provision of the compensation. Apparently, the implementation of the recommendations made on legal action against the persons involved in the incidents of human rights violation and excess is in a very dismal state.
