Ruling party is finally taking up the matter for discussion as it has become a hotly debated national political issue.

The Nepali Congress has scheduled a Central Working Committee meeting on Friday to constitute what it calls “central work execution committee” which leaders say will discuss various contemporary issues, including the local election, one of the most hotly debated issues over the past few days.

Congress President and Prime Minister Sher Bahadur Deuba decided to call the meeting after pressure to constitute such a committee, insiders say.

Party General Secretary Gagan Thapa said that formation of the work execution committee became necessary as holding in-person meetings of the Central Working Committee (CWC) is not possible due to the ongoing Covid-19 pandemic.

“Friday’s virtual meeting will constitute the central work execution committee as envisioned by the party statute. As it is smaller than the CWC, we can hold even in-person meetings,” Thapa told the Post. “The central work execution committee’s meeting will be called in a couple of days to discuss the burning issues, mainly the local election date.”

After Communist Party of Nepal (Maoist Centre) chair Pushpa Kamal Dahal proposed holding parliamentary elections in April-May by delaying local polls, confusion has arisen if that is indeed possible, constitutionally and legally.

While the ruling alliance has been mulling over Dahal’s proposal—the government is even considering amending at least two laws—one related to local election and another about the functioning of local governments—to make them compatible with the constitution—the Nepali Congress has not discussed the issue within the party yet.

Experts and observers as well as some leaders, including those from the Congress, told the Post earlier this week that critical issues like elections must be discussed within the legitimate party committees before letting any political committee decide on such issues. They were referring to the high-level political coordination committee, a mechanism formed by the five-party ruling alliance to “assist the government”, which does not have any legal or constitutional standing.

Congress insiders say pressure was building on the leadership to discuss the local election issue.

The 154-member Congress CWC has 134 members at present. The central work execution committee, or CWEC, has 31 members picked by the party president from among the CWC members in addition to 14 office bearers.

While Deuba appears to be convinced with Dahal’s proposal to delay local election, many leaders in Congress, including Thapa, believe that the election should be held on the date(s) proposed by the Election Commission.

The Election Commission has proposed local polls to elect representatives for 753 local units on April 27. It has said election can be held on April 27 and May 5 if the government wishes to hold them in two phases.

Amid the exercise to delay the local polls, there, however, are strong voices within Congress to stick to the commission’s proposal.

“I strongly stand for local election in April-May,” Jeevan Pariyar, the party’s deputy general secretary, told the Post. “I am going to demand that the party leadership abide by the Election Commission’s proposal.”

Besides the Maoist Centre, the CPN (Unified Socialist) is also arguing that local polls should be delayed and federal elections should be held in April-May.

The main opposition CPN-UML has already opposed the idea of postponing local election, saying such a move would be against the rule of law.

In the Congress party, some leaders close to Deuba too have been demanding that local election should be held on the commission-proposed date(s).

“I am for holding local election in Baisakh (April-May). To my knowledge, even the prime minister wants the same. However, he is under pressure from the coalition partners,” Ramesh Lekhak, a Congress CWC member who is considered close to Deuba, told the Post.

He said that there is a strong view within the party that there must be an understanding in the party committee on issues like elections.

Constitutional experts say that the Congress, as a democratic party, must reject the idea of postponing the local election. It is unfortunate that the five-party alliance, which the leaders claim was formed to safeguard the constitution, is bent on breaching the constitution, according to the experts.

Dinesh Tripathi, chairperson of the Constitutional Lawyers Forum, said the constitution clearly says the terms of the local representatives will be for five years.

“Various constitutional provisions and laws should be seen in isolation. There is a need to understand the spirit. The six-month provision in Article 225 of the constitution is for emergency situations [should they arise],” Tripathi told the Post. “There is still time to announce the poll date. Congress should take a mature decision so that it won’t be blamed for undermining the constitution.”

Article 225 of the constitution says the term of “a village assembly and municipal assembly shall be for five years from the date of elections.”

Another village and municipal assembly should be elected no later than six months of the expiry of such a term, it adds.

Article 215, however, says the terms of chairperson, vice-chairperson, ward chairperson and members would be for five years from the date of being elected.

Many are now saying there is a need to differentiate between assemblies (village and municipal) and elected local representatives. As per the constitutional provisions, once local representatives are elected, they ultimately form the village and municipal assemblies.

Experts say Deuba and his party are under pressure not to delay the local election.

“It’s not easy for the Deuba government to postpone the local election as the voice against the idea is growing louder,” Bipin Adhikari, a professor and a former dean of Kathmandu University School of Law, told the Post. “The government must not get swayed away by pressure from the Maoist Centre and the CPN (Unified Socialist).”

Amid the raging debate over elections, President Bidya Devi Bhandari on Thursday suggested that the government hold the polls on time.

During a meeting with Prime Minister Deuba, Bhandari inquired about the government’s position on holding the local election.

“The President called for timely elections as per the spirit of constitution,” Bhesh Raj Adhikari, the President’s personal principal secretary, told the Post. “The prime minister said he will take a decision after holding discussions among the parties.”

Experts say the political coordination committee, formed ‘to assist the government’ should refrain from dictating on important matters like elections.

It all started with a proposal by Communist Party of Nepal (Maoist Centre) chair Pushpa Kamal Dahal, and it has now spiralled into a full-blown political debate. Now some key questions have also arisen.

At a meeting of the high level political coordination committee on January 18, Dahal, by his own admission, proposed that parliamentary elections should be held in April-May instead of local polls at that time.

His proposal came at a time when the Election Commission had already proposed April 27 and May 5 as the local poll dates.

The political coordination committee, led by Ram Chandra Poudel, then decided to consult legal and constitutional experts after there was a dominant view that all three tiers of election should be held simultaneously.

The select group of experts suggested that there is a leeway to hold local elections six months after the expiry of the terms of existing representatives.

Those seeking to delay local polls have argued that since the election laws are not consistent with the constitution, they need to be amended to make them compatible with the country’s top law.

The process to draft an amendment bill to revise the existing Local Level Election Act has already begun, according to Ganga Lal Tuladhar, deputy general secretary of the CPN (Unified Socialist). A group of experts in coordination with the Ministry of Law, Justice and Parliamentary Affairs will prepare the first draft “as per the decision of the coordination committee.”

But what is the high level political coordination committee anyway?

Neither the constitution nor any law recognises the committee formed by the five-party ruling alliance.

The main opposition CPN-UML has already opposed the idea of delaying local elections, saying that such an exercise by the ruling alliance is against the rule of law. Even within the ruling Nepali Congress, there is a section which is opposing Dahal’s proposal, which has been seconded by the CPN (Unified Socialist).

Some Congress leaders say a decision on such a crucial issue like elections is being decided by the coordination committee, while there have been no discussions on the matter in the political parties’ legitimate bodies.

Dhan Raj Gurung, a Congress vice-president, said there has to be intense discussions within the party organisations and all-party meetings before deciding on such important matters.

“A mechanism that doesn’t have any legal and constitutional recognition shouldn’t be taking decisions and dictating the government,” Gurung told the Post. “It would be better if the parties discuss the issue at their committees, which are legitimately elected entities, then take the matter to all-party meetings before any decision is taken.”

Gurung’s party is yet to discuss the matter at the Central Working Committee which is the legitimate body elected by the general convention.

Though Tuladhar claimed that his party has discussed the matter in the party’s Standing Committee, other parties haven’t held formal discussions on the issue.

The Maoist Centre hasn’t discussed the issue at its Central Committee while it is yet to constitute the Standing Committee. The Janata Samajbadi Party, another party in the alliance, too hasn’t held its Central Committee meeting for quite a while.

The five-party alliance’s coordination committee itself is a controversial entity.

It was basically Dahal’s idea to constitute such a committee “to assist the government.” He had pushed a similar idea during KP Sharma Oli’s tenure as prime minister when both were together in the same Nepal Communist Party (NCP) formed in May 2018 after a merger between the UML and the Maoist Centre. An infighting in the NCP—a tussle between Oli and Dahal to be precise—led to the party’s invalidation in March last year. Nepali Congress President Sher Bahadur returned to power with the backing of Dahal’s Maoist Centre on July 13 this year.

The committee was formed in November last year amid controversy. Multiple leaders and observers had called it a farce and said Dahal has a tendency to push for such a mechanism to ensure that he can have his say in governance and various other issues when he is out of power.

This time, Dahal used the mechanism to influence other political leaders, including Prime Minister Deuba, to postpone local polls.

Experts say the recent move of the ruling parties demonstrates the lack of consultative culture, which is fundamental in a democracy, among the parties.

Daman Nath Dhungana, a former Speaker and civil society member, says the coordination committee is an extralegal entity which alone shouldn’t be allowed to take decisions on issues like elections.

“Leaders are guided by self-interest so they tend to avoid larger discussions where their ideas could be rejected,” Dhungana told the Post. “Parties avoiding inter- and intra-party discussions and taking decisions from an extralegal mechanism cannot be a democratic culture.”

According to Dhungana, no matter what argument top leaders of the ruling parties offer, not holding local elections latest by May will be in violation of the constitution.

Those avoiding local elections in April-May have been making their arguments by misinterpreting a constitutional provision, some experts and leaders say. The constitution actually does not envision a vacuum at the local level, according to them.

Amid the ongoing wrangling over delaying local elections, the Election Commission on Tuesday urged the government to announce the dates without any further delay. Issuing a statement, the commission said the delay in announcing poll dates could cause complexities in holding the elections managerially and technically. The commission has been saying the local polls should be held on April 27, if they were to be held in one phase and on April 27 and May 5, if voting is staggered into two phases.

Experts and former election officials have for long been saying that until the Election Commission is given the full authority to declare election dates, politicians and political parties will continue to push for conducting polls at the dates that suit them best.

It is unfortunate that political parties have made the Election Commission toothless and made an extralegal coordination committee a powerful entity, according to experts on constitutional affairs.

Raju Prasad Chapagain, former chair of the Constitutional Lawyers’ Forum, said Maoist Centre chair Dahal has used the committee to impose his ideas on the Deuba government.

“The government seems to have become a pawn of the committee which is unfortunate,” Chapagain told the Post. “Deuba is dancing to the tune of the committee where Dahal holds sway. The country is going to suffer as the committee is prevailing over the government.”

Some experts say the Poudel-led committee’s role should have been limited to discussing some issues related to governance, as the current government is a coalition one of five parties. But it appears to have become a decision-making entity and is taking decisions on issues of national importance, according to them.

Bipin Adhikari, a former dean of Kathmandu University School of Law, said Deuba’s commitment to democracy will be questioned if his government decides to postpone local polls.

“He is accepting what the committee says because he fears a split in the alliance which will push him to minority,” Adhikari told the Post. “But even if the coalition falls apart, it is his government that will hold the polls. Deuba is in a comfortable position.”

संवैधानिक कानुनविद् विपिन अधिकारी भन्छन्, ‘संसदीय पद्धतिमा निर्वाचनको म्यान्डेट सकिन लागेको वर्षमा दुई-चार महिना अगाडि निर्वाचन गर्ने भन्ने सामान्य परम्परा अन्तर्गत नै हुन्छ ।’

काठमाडौँ — स्थानीय तहको चुनाव मुखमा आएका बखत सत्तारुढ गठबन्धनले त्यससँगै प्रतिनिधिसभा र प्रदेशसभाको पनि निर्वाचन गर्ने विषयमा छलफल गरिरहेको छ। निर्वाचन आयोगका अनुसार प्रतिनिधिसभाको निर्वाचन दुई वटा अवस्थामा हुने गर्दछ – पहिलो, अगावै विघटन भएमा। दोस्रो, कार्यकाल सकिएमा।

सभा विघटन गर्नका लागि संविधानले तोकेका प्रक्रिया पुरा हुनुपर्छ साथमा दुईदुई पटकको विघटनलाई बदर गर्दा सर्वोच्च अदालतले कायम गरेका मापदण्ड पनि पूरा हुनुपर्छ । अहिले उक्त अवस्था छैन ।

त्यसैले प्रतिनिधिसभाको निर्वाचन हुने अवस्था कार्यकाल सकिएपछि हो । तर स्पष्ट कानुनी व्यवस्थाको अभावले गर्दा हाल कायम सभाको कार्यकाल कहिले सकिन्छ भन्नेमा अन्योल छ । अर्कोकुरा कार्यकाल सकिएपछि मात्र निर्वाचन प्रक्रिया सुरु गर्दा लामो समय मुलुक प्रतिनिधिसभाविहीन हुनसक्ने भएकाले कार्यकाल सकिउन्जेलसम्ममा नयाँ सभा आउनुपर्ने गरी प्रबन्ध गर्नुपर्ने देखिन्छ । तर यसका लागि पनि स्पष्ट कानुनी व्यवस्थाको अभाव छ ।

प्रधानमन्त्री शेरबहादुर देउवाले राष्ट्रका नाममा सम्बोधन गर्दै शुक्रबार २०७९ सालमा तीन वटै तहको निर्वाचनको तयारीमा सरकार रहेको जानकारी गराएका छन् । संविधानले तीन वटै तहका निर्वाचित पदाधिकारीको कार्यकाल ५ वर्षको हुने व्यवस्था गरेकोले आउँदो वर्ष चुनाव गर्नैपर्ने संवैधानिक बाध्यता छ । २०७४ मा दुई चरणमा चुनाव भएको प्रतिनिधिसभाको पाँच वर्षे कार्यकाल २०७९ मा त सकिन्छ । तर कुन महिनाको कति गते भन्नेमा भने प्रशस्त अन्योल छ ।

२०७४ मंसिरको १० र २१ गते गरी दुई चरणमा प्रतिनिधिसभाको प्रत्यक्षतर्फका १६५ निर्वाचन क्षेत्रमा चुनाव भएको थियो । त्यसैवर्षको फागुन २ गते मात्रै निर्वाचन आयोगले राष्ट्रपति विद्यादेवी भण्डारीलाई समानुपातिकको समेत गरी निर्वाचनको नतिजा बुझाएको थियो ।

फागुन २० मा प्रतिनिधिसभाका सांसद्हरूले सपथ लिएका थिए भने फागुन २१ मा प्रतिनिधिसभा र राष्ट्रिय सभा गरी संघीय संसद्को संयुक्त बैठक बसेको थियो ।

मंसिरदेखि फागुनसम्म भएका यी घटनाक्रममध्ये कुन मितिलाई प्रतिनिधिसभाको कार्यकाल सुरु भएको मान्ने भन्नेबारेमा अहिले दलहरूका बीचमा मात्र होइन, संसद् सचिवालय र निर्वाचन आयोगमा पनि अन्योल देखिएको छ । कतिपयले निर्वाचन भएको मितिलाई कार्यकालको प्रारम्भ बिन्दु मान्नुपर्ने बताउँछन् भने कतिपयले निर्वाचन आयोगले राष्ट्रपतिलाई नतिजा बुझाएको मितिलाई । कतिपयले सांसद्हरूले सपथ लिएको मितिलाई कार्यकाल प्रारम्भ भएको मान्नुपर्ने बताउँछन् भने अन्य कतिपयले पहिलो बैठक बसेको मितिलाई ।

स्थानीय तहको हकमा ‘स्थानीय तह निर्वाचन ऐन’ ले पहिलोपटकका लागि चुनाव भएको सातौं दिनलाई पदाधिकारी निर्वाचित भएको मान्ने व्यवस्था गरेको छ । विभिन्न चरणमा निर्वाचन भएमा पनि पहिलो चरणको मितिमा भएको मानिने र त्यसको सात दिनपछि कार्यकाल सुरु हुने व्यवस्था छ ।

हालको संविधानअनुसार पहिलोपटकक भएको निर्वाचनका लागि ऐनले यस्तो व्यवस्था गरेकोमा आगामी दिनमा भने निर्वाचनको भोलिपल्टको मितिलाई कार्यकाल सुरु भएको मान्ने व्यवस्था ऐनमै छ । त्यस्तै राष्ट्रिय सभाका हकमा संविधानकै धारा ८६ (४) ले ‘राष्ट्रिय सभाको प्रथम बैठक बसेको दिनबाट सम्पूर्ण सदस्यहरूको पदावधि प्रारम्भ भएको मानिनेछ’ भन्ने व्यवस्था गरेको छ । तर, प्रतिनिधिसभाका हकमा स्थानीय तह र राष्ट्रिय सभाको हकमा जस्तो स्पष्ट व्यवस्था कतै छैन ।

प्रतिनिधिसभाका सचिव गोपालनाथ योगीले यस विषयमा संसद् सचिवालयमा पनि छलफल भएको र स्पष्ट कानुनी व्यवस्थाका अभावमा आफूहरू पनि अन्योलमा रहेको बताए । निर्वाचन आयोगका कानुन तथा राजनीतिक दल व्यवस्थापन महाशाखा प्रमुख यज्ञप्रसाद भट्टराई संविधान र कानुनले स्पष्ट नबोलेको बताउँछन् ।

‘कतै पनि त्यससम्बन्धी व्यवस्था नभएकाले कहिलेदेखि कार्यकाल प्रारम्भ भयो र कहिले सकिन्छ भन्नेमा अन्योल देखिएको छ,’ उनले भने, ‘तर, राष्ट्रिय सभाका हकमा संविधानले नै कायम गरेको मितिलाई प्रतिनिधिसभाका हकमा पनि मानेर जानेगरी व्याख्या गर्नु उपयुक्त हुन्छ । त्यसअनुसार आगामी फागुन २० लाई प्रतिनिधिसभाको कार्यकाल सकिने मिति मान्न सकिन्छ ।’

प्रतिनिधिसभाको कार्यकाल सकिने मितिको आवश्यकता किन परेको हो भने त्यसैका आधारमा चुनाव कहिले गर्ने भन्ने निर्क्योल गर्नुपर्छ । अगावै विघटन नभएमा प्रतिनिधिसभाको कार्यकाल पाँच वर्षको हुने संविधानको व्यवस्थाले गर्दा चुनाव गर्ने मिति प्रतिनिधिसभाको कार्यकाल अनुसार निर्धारण गर्नुपर्छ । त्यसैले चुनावको मिति तय गर्नुअघि प्रतिनिधिसभाको कार्यकाल कहिले सकिन्छ भन्नेबारे स्पष्ट हुन आवश्यक छ ।

अघिल्ला प्रधानमन्त्री केपी शर्मा ओलीले गतवर्षको पुस ५ र यही वर्षको जेठ ८ मा गरेको प्रतिनिधिसभा विघटन बदर गर्ने फैसला गर्दा सर्वोच्च अदालतले प्रतिनिधिसभालाई पूर्ण कार्यकाल चल्न दिनुपर्ने नजीर बनाएको छ ।

असार २८ मा त्यस्तो फैसला गर्ने इजलासमा संलग्न पाँचमध्येका एक न्यायाधीश एक वर्षमा प्रतिनिधिसभाका दुईवटा अधिवेशन चल्ने कारणले निर्वाचन वर्ष (पाँचौ वर्ष) का दुवै अधिवेशसन चलिसकेपछि निर्वाचनमा जाँदा अदालतको फैसला विपरीत नहुने बताउँछन् ।

‘पाँच वर्ष पूरा भएपछि मात्रै निर्वचान गर्ने भन्ने तर्क गर्दा कार्यकाल सकिएपिछ चुनाव नहोउन्जेलसम्म मुलुक प्रतिनिधिसभाविहीन हुनसक्छ । त्यसैले अन्तिम वर्षका दुवै अधिवेशन चलेपछि एकाध महिना पहिले नै निर्वाचनमा जाँदा पनि प्रतिनिधिसभाले पूर्ण कार्यकाल काम गरेको मान्न सकिन्छ’, ती न्यायाधीशले भने ।

एकथरी संविधानविद्हरू भने निर्वाचन वर्ष (पाचौं वर्ष) मा प्रवेश गरेपछि जुनसुकै महिनामा पनि चुनाव गर्न सकिने, प्रतिनिधिसभाको कार्यकाल सकिने महिना र गते पर्खन नपर्ने बताउँछन् । ‘यो सरकार गत निर्वाचनको म्यान्डेट अनुसार अर्को निर्वाचन गर्नुपर्ने वर्षमा प्रवेश गरिसकेको छ । त्यसैले निर्वाचन गर्न सरकारले तयारी गर्ने बेला हो यो,’ संवैधानिक कानुनविद् विपिन अधिकारी भन्छन्, ‘संसदीय पद्धतिमा निर्वाचनको म्यान्डेट सकिन लागेको वर्षमा दुई-चार महिना अगाडि निर्वाचन गर्ने भन्ने सामान्य परम्परा अन्तर्गत नै हुन्छ ।’

संवैधानिक कानुनका जानकार रहेका उच्च अदालतका एक जना न्यायाधीश पनि पाँचौ वर्षका कुनै पनि महिनामा निर्वाचन गर्नसकिने उपाय सुझाउँछन् ।

‘हरेक पटकको निर्वाचन उही समयमा गर्न सम्भव नहुन सक्छ । त्यसैले प्रत्येक आवधिक निर्वाचन गर्न पाँचौं वर्षको अन्तिम दिन कुर्न पर्दैन,’ ती न्यायाधीशले कान्तिपुरसँग भने, ‘सांसद् भनेका जनताका वारेस हुन् । जनताले निर्वाचनमार्फत् दिएको आफ्नो प्रतिनिधित्व गर्ने अधिकार पाँच वर्ष पुगिसकेपछि सकिन्छ । त्यसैले त्यसअघि नै त्यसलाई रिन्यू गर्नुपर्छ । एकाध महिना अगाडि चुनाव गर्न केही बिग्रदैन।’

संविधान वा कुनै कानुले स्पष्ट रूपमा उल्लेख नगरे पनि जनतामा निहित सार्वभौमसत्ताको अभ्यास गर्ने लोकतान्त्रिक मूल्य मान्यताले गर्दा पाँचौ वर्षको कुनै पनि अवधिमा चुनाव गर्दा संविधान र अदालतले अवरोधन नगर्ने उनको विचार छ ।

अन्य कतिपय कानुनविद्ले भने निर्वाचनका लागि प्रतिनिधिसभाको पूर्ण कार्यकाल नपर्खने हो भने पाँचौं वर्षमा प्रवेश गरेपछि प्रतिनिधिसभा स्वयंले निर्वाचनमा जाने प्रयोजनका लागि आफूलाई विघटन गर्ने प्रस्ताव पारित गर्न आवश्यक रहेको बताउँछन्।

अधिवक्ता टीकाराम भट्टराई ‘संसदीय व्यवस्थामा संसद्ले आफैंलाई मारेर चुनावमा जानसक्ने अभ्यासहरू रहेको’ उल्लेख गर्दै यस्तो अभ्यास कार्यकाल अगावै निर्वाचनमा जाने विकल्प हुनसक्ने बताउँछन् ।

‘संसदीय व्यवस्थाको जननी मानिने बेलायतले सन् २०११ मा बनाएको ‘फिक्स्ड टर्म पार्लियामेन्ट एक्ट’ मा यस्तो व्यवस्था छ, त्यसको अभ्यास हामीले पनि गर्नसक्छौं,’ भट्टराईले भने ।

वैशाखमै प्रतिनिधिसभाको निर्वाचन गर्ने प्रस्ताव गठबन्धनमा राखेका माओवादी केन्द्रका अध्यक्ष पुष्पकमल दाहालले पनि यसैगरी सभाले नै प्रस्ताव पास गर्नसक्ने विकल्प अगाडि सारेका थिए । पार्टीगत राजनितक स्वार्थका लागि मुखमै आएको स्थानीय तहको निर्वाचन टार्ने योजनासहित दाहालले यस्तो विकल्प अगाडि सारेको भन्ने आरोपमा यो प्रस्तावको व्यापक आलोचना भएको छ ।

स्थानीय तहको निर्वाचनको सन्दर्भ हुँदैनथ्यो भने पनि यस्तो विकल्पलाई नेपालको संविधान र कानुनले ‘ब्याकअप’ भने गर्दैनन् । ‘यस्तो विकल्प कुनै पनि कानुन र संविधानले दिएको छैन । दलहरूले संविधान र ऐन नै संशोधन नगरेसम्म मिल्दैन,’ निर्वाचन आयोगका प्रवक्ता शालिग्राम शर्मा पौडेलले भने।

काठमाडौँ — निर्वाचन आयोगको ताकेतापछि पनि स्थानीय तहको निर्वाचनको मिति घोषणा गर्न अलमल गरिरहेको सत्ता गठबन्धनमा संघीय संसद्को निर्वाचनको विषयले प्रवेश पाएको छ । माओवादी केन्द्रका अध्यक्ष पुष्पकमल दाहालले वैशाख/जेठमा संसदीय र कात्तिक/मंसिरमा स्थानीय निर्वाचन गर्ने प्रस्ताव राखेका छन् ।

गठबन्धनले यो विषयमा एक/दुई दिन छलफल गरेर निष्कर्षमा पुग्ने बताएको छ भने प्रमुख प्रतिपक्षीले भने स्थानीय निर्वाचन टार्ने जालझेल भनेको छ ।

‘वैशाख–जेठमा प्रतिनिधिसभा निर्वाचन गर्न संवैधानिक व्यवधान छैन’

आगामी वैशाख–जेठमा प्रतिनिधिसभा निर्वाचन गर्न कुनै व्यवधान छैन । यो सरकार संविधानको धारा ७६ (५) को हो । योभन्दा कमजोर सरकार बनाउने बाटो संविधानमा छैन । कुनै कारणले यो सरकार कायम रहने परिस्थिति नभएमा सरकार निर्माणका सबै प्रक्रियाहरू समाप्त भइसकेको मानेर प्रतिनिधिसभा विघटन गरी निर्वाचन घोषणा गर्न सकिन्छ ।

अर्को तरिकाले पनि चुनाव हुन सक्छ । गत निर्वाचनको जनादेश पाँचौं वर्षमा प्रवेश गरिसकेको छ । पाँचौं वर्ष आफैंमा निर्वाचन वर्ष पनि हो । त्यो दृष्टिकोणले निर्वाचन गर्न सरकारले तयारी गर्ने बेला हो यो । संसदीय पद्धतिमा निर्वाचनको म्यान्डेट सकिन लागेको वर्षमा दुई–चार महिना अगाडि निर्वाचन गर्ने विषय सामान्य हो । यस्तो प्रचलन पनि छ ।

अहिले सरकारले संसद् चलाउन सकेको छैन । हिजोको केपी शर्मा ओलीको सरकारले पनि दुई सत्र कामै नगरी समाप्त गरेको हो । राजनीतिक समन्वय गर्न नसक्दा विधेयकहरूमाथि मतदान भएन । अहिलेको सरकार पनि एमसीसीलगायत विषयले धेरै अप्ठ्यारोमा छ र गठबन्धन आफैं अन्योलमा छ । चुनाव भएमा नयाँ जनादेशका आधारमा निर्णय गर्दै जान सकिन्छ भनेर पनि यो विकल्प खोजिएको हुन सक्छ ।

प्रधानमन्त्री (देउवा) निर्वाचनमै जान खोजेका छन् भन्ने देखिन्छ । तर, एकीकृत समाजवादी पार्टी र माओवादी केन्द्रको सघन व्यक्तित्व र संगठन बनिसकेको छैन भनेर निर्वाचनमा जान गाह्रो मानेजस्तो देखिएको हो । अब उनीहरूसमेत तयार भइसकेको हो भने प्रधानमन्त्रीसँग अधिकार छ, उनले देशलाई निर्वाचनमा लग्न सक्छन् ।

माघ पहिलो साताभित्रै मिति नतोकिए स्थानीय तहको निर्वाचन वैशाखमा गर्न कठिन हुने भन्दै निर्वाचन आयोगले सरकार र दलहरूको ध्यानाकर्षण गराउँदै आएको छ । यो विषयमा छलफल गर्न मंगलबार बसेको उच्चस्तरीय राजनीतिक समन्वय समिति बैठकमा दाहालले पहिले संसदीय र पछि स्थानीय निर्वाचन गर्ने प्रस्ताव राखेका हुन् । समितिको बैठक बिहीबार पनि बस्दै छ ।

सर्वोच्च अदालतको फैसलाबाट पुनःस्थापित संसद्मा प्रमुख प्रतिपक्षी दल एमालेले लगातार संसद् अवरोध गर्दै आएकाले अब विकल्प खोज्नुपर्ने बेला आएको भन्दै दाहालले संसदीय निर्वाचनको प्रस्ताव राखेको बताएका छन् । ‘हामी त संसद्लाई पूरै अवधि चलाउन चाहन्थ्यौं । ६ महिनादेखि लगातार केपी ओलीलाई संसद् सुसञ्चालन गर्न सहयोग गर्नुस् पनि भन्यौं । तर, प्रमुख प्रतिपक्षी यो सदन रहेसम्म अवरोध गर्ने नीतिमा देखियो । यो अवस्था लोकतन्त्र, संविधानका निम्ति घातक हुने भयो । त्यसो भए निर्वाचनकै वर्षमा केही महिना पहिले निर्वाचनमा नै किन नजाने त भनेर हामी छलफलमा छौं,’ दाहालले बुधबार साँझ कान्तिपुरसँग भने ।

संवैधानिक व्यवस्थाअनुसार ६ महिनाभित्र स्थानीय निर्वाचन गर्न सकिन्छ : दाहाल
सदन सञ्चालनका लागि गठबन्धनले गरेको प्रयास निरर्थक भएको दाहालको भनाइ छ । ‘कहिले बालुवाटारमा सर्वदलीय बैठक बोलाएर त कहिले प्रधानमन्त्रीजी आफैं बालकोट गएर संवाद गर्दा पनि एमालेले सदन सञ्चालन हुन नदिने नीति लियो, यो एउटा परिस्थिति छ । दोस्रो, वैशाखदेखि चुनावी वर्ष सुरु नै हुन्छ । त्यसकारण किन संघीय संसद्को निर्वाचन गरेर अहिलेको गतिरोध अन्त्य नगर्ने त भन्ने हिसाबले प्रस्ताव राखिएको हो,’ उनले भने ।

स्थानीय तहको निर्वाचन वैशाखमा सकेर जेठ पहिलो साता नवनिर्वाचित पदाधिकारीले पदभार गरिसक्नुपर्ने कानुनी प्रावधान छ । त्यसको विकल्पमा शून्यताको परिकल्पना कानुनले गरेको पनि छैन । तर संविधानको धारा २२५ मा पाँच वर्ष पुगेपछि ६ महिनाभित्र स्थानीय तहको निर्वाचन गरिसक्नुपर्ने व्यवस्था भएकाले संवैधानिक व्यवस्थाको अवज्ञा नहुने दाहालको दाबी छ । ‘अहिले निर्वाचन आयोगले जे भनिराखेको छ, त्यो ऐनको व्यवस्थाअनुसार ठीकै हो । संविधानको व्यवस्थाअनुसार पनि ६ महिनाभित्र गर्ने भनेको कात्तिक/मंसिरभित्र स्थानीय निर्वाचन गर्न सकिन्छ,’ उनले भने ।

सर्वोच्च अदालतको फैसलामा संसद् पूरै अवधि चल्नुपर्ने सर्त राखिए पनि सदनकै बहुमतले अब चुनाव गर्नु उचित हुन्छ भन्ने प्रस्ताव पारित गरेमा सर्वोच्चको आदेशलाई पनि सम्मान हुने दाहालको दाबी छ । प्रमुख प्रतिपक्ष एमालेले नै चुनाव हुन्छ भने हाम्रो समर्थन हुन्छ भनेको स्थितिलाई हेर्दा राष्ट्रिय सहमति पनि हुने उनको भनाइ छ ।

‘स्थानीय तहको निर्वाचन टार्ने जालझेल हो’ : रिमाल

तर प्रमुख प्रतिपक्ष एमालेले भने स्थानीय तहमा पराजय हुने निश्चित भएपछि निर्वाचन सार्न सत्ता गठबन्धनले जालझेल गरेको आरोप लगाएको छ । उपमहासचिव विष्णु रिमालले स्थानीय तहको नेतृत्व एक दिन पनि खाली हुने अवस्था एमालेले अस्वीकार गर्ने बताए । ‘उहाँहरू प्रदेश र संघको निर्वाचन अगाडि गर्न चाहनु हुन्छ भने त्यसमा आपत्ति भएन, जेठको ६ मा स्थानीय तहमा नयाँ प्रतिनिधि आउनुपर्छ, यो हाम्रो सर्त हो ।’

उता सत्ताको नेतृत्वमा रहेको कांग्रेस नै प्रतिनिधिसभा विघटन गरेर निर्वाचनमा जाने विषयमा स्पष्ट छैन । प्रतिपक्षीसँग द्वन्द्वका कारण प्रतिनिधिसभाले प्रभावकारी काम गर्न नसक्ने निष्कर्षका साथ सरकारको नेतृत्व लिएको सुरुवाती दिनमा ‘अर्ली इलेक्सन’ मा जान कांग्रेसले छलफल चलाएको थियो । कांग्रेस नेता रमेश लेखकका अनुसार माओवादी केन्द्र र एकीकृत समाजवादी नमानकै कारण त्यो छलफल रोकिएको हो । अब भने त्यस्तो सम्भावना आफूले कम देखेको लेखकको भनाइ छ ।

‘अब कुनै पनि बहानामा स्थानीय तहको निर्वाचन वैशाखभन्दा पर सार्न हुन्न,’ प्रधानमन्त्री देउवाका विश्वासपात्रसमेत रहेका नेता लेखकले कान्तिपुरसँग भने, ‘वैशाखमा स्थानीय तहकै निर्वाचन गर्ने हो भने ठीकै छ । तर वैशाखमा प्रतिनिधिसभाको निर्वाचन हुनुपर्छ भनेर स्थानीय तहको निर्वाचन रोक्न निर्वाचन नै नहुने अवस्था आउन सक्छ ।’

संविधानको धारा २२५ ले गाउँसभा र नगरसभाको कार्यकाल पाँच वर्षको हुने र त्यस्तो कार्यकाल समाप्त भएको मितिले ६ महिनाभित्र अर्को गाउँसभा र नगरसभाको निर्वाचन सम्पन्न गर्नुपर्ने व्यवस्था गरेको छ । राजनीतिक दलका नेताहरूले यसैलाई आधार मानेर स्थानीय तहको निर्वाचन ६ महिनापछि सार्न सकिने तर्क गरिरहेका छन् । लेखकका अनुसार गाउँसभा र नगरसभा स्थानीय तहको निर्वाचन भएपछि हुने दोस्रो चरणको निर्वाचन हो । ‘स्थानीय तहको निर्वाचन भएपछि नगर र गाउँसभाको गठन हुन्छ । जुन संविधानले व्यवस्था गरेअनुसार निर्वाचनबाटै गठन हुने प्रबन्ध छ । यसमा संविधान र कानुनको व्यवस्था बाझिएको छैन,’ उनले भने ।

उता, जनता समाजवादी पार्टीका संघीय अध्यक्ष बाबुराम भट्टराईले भने पहिले संसदीय निर्वाचन गर्ने प्रस्तावमा संविधानविद्, कानुनविद् र निर्वाचन आयोगसँग सल्लाह गरेर टुंगो गरिने बताए । यो विषयमा सत्तापक्षीय दलहरू आन्तरिक छलफलमा रहेको पनि उनले भनाइ छ । ‘संवैधानिक र कानुनी जटिलता नहुने हो भने संघीय लोकतन्त्रमा सामान्यतया संघ र प्रदेशपछि स्थानीय तहको निर्वाचन सुल्टो तरिका हो । तर हामीले छलफल गरेर मात्र निष्कर्षमा जानेछौं,’ भट्टराईले भने ।

उनले अहिले ऐन र संविधानमा केही विषय बाझिएकाले एकरूपता ल्याउने प्रयास भइरहेको पनि बताए । ‘स्थानीय तहका पदाधिकारीको म्याद सकिन दुई महिना अगाडि निर्वाचन गर्ने भनेर ऐनले अस्पष्ट ढंगले भनेको छ तर संविधानले म्याद सकिएको ६ महिनासम्म निर्वाचन गर्न सकिने भनेको छ, संविधानभन्दा माथि ऐन हुँदैन,’ भट्टराईले भने, ‘तर प्रतिगमनकारी शक्तिले नै हामीलाई निर्वाचन गराउन नखोजेको, सार्न खोजेको भन्दै भ्रम फैलाउन खोजेका छन् ।’

२९ पुस, काठमाडौं । प्रमुख विपक्षी दल नेकपा एमालेले संघीय संसद निरन्तर अवरोध गरेको तीन महीना पुग्न लाग्यो । २३ भदौ २०७८ देखि ११ कात्तिकसम्मको ५१ दिन चलेको अधिवेशनको पूरै अवधि सँगै २८ मंसीरबाट शुरु भएको चालू अधिवेशन पनि एमालेले अवरुद्ध गर्दै आएको छ । यति लामो समय एमालेकै कारण संसद चल्न सकेको छैन । यसको एउटै कारण हो- नेकपा एकीकृत समाजवादी पार्टीको अस्तित्व अस्वीकार ।

एमाले फुटाएर माधव नेपाल नेतृत्वमा नेकपा एकीकृत समाजवादी गठन भएपछि प्रमुख प्रतिपक्षीले निरन्तर संसद अवरोध गर्दै आएको छ । एमाले सांसदहरुले नेपाल नेतृत्वको एकीकृत समाजवादीका सांसदहरुलाई ‘गैरसांसद’ को संज्ञा दिंदै आएका छन् । उनीहरुले संसदमा लगाउने नारा हो, ‘गैर सांसदलाई प्रवेश निषेध गर !’

एमालेले माधव नेपाल नेतृत्वको पार्टीलाई अस्वीकार गरेको नयाँबानेश्वरस्थित संसद भवन मात्रै हो ।

मिनी संसदको रुपमा चिनिने संसदका विषयगत समितिमा भने एमाले सांसदहरु आफूले गैर सांसद भनेकाहरुसँग बैठक बसिरहेका छन् । एकीकृत समाजवादीका सांसदलाई ‘माननीयज्यू’ र मन्त्रीलाई ‘मन्त्रीज्यू’ भनेर सम्बोधन गर्छन् । एकले अर्कोको अस्तित्व स्वीकार गर्छन् र सवालजवाफ चलिरहेको हुन्छ ।

समितिमा निर्देशन दिने, संसदमा टिक्न खानै नदिने

एमाले र एकीकृत समाजवादीका सांसदहरुबीच नयाँबानेश्वरस्थित संघीय संसद भवनमा पानी बाराबारको अवस्था त्यहाँबाट बाहिर निस्किएपछि रहँदैन । एमाले सांसद कृष्णभक्त पोखरेल सभापति रहेको प्रतिनिधिसभाको कानून, न्याय तथा मानवअधिकार समितिले संसदको बिजनेस अघि बढाउन संसद र सरकारलाई निर्देशन नै जारी गर्‍यो ।

८ पुस २०७८ मा बसेको समिति बैठकको निर्णयको ड्राफ्ट समिति सदस्यहरुलाई सुनाउँदै सभापति पोखरेलले भनेका थिए, ‘सरकारले चाहेका विषय अगाडि बढाएकै छ । त्यसकारण नागरिकता विधेयकलाई तुरुन्त अघि बढाउन सरकारलाई भनौं ।’

सभापतिको भनाइमा समर्थन जनाउँदै माओवादी केन्द्रका प्रमुख सचेतक समेत रहेका समिति सदस्य देव गुरुङले भने, ‘संसदको अवरोध खोल्न निर्देशन जारी गर्ने कि ! यसो गर्दा निर्देशन कार्यान्वयन हुन्छ ।’

लोकतान्त्रिक समाजवादीका सांसद लक्ष्मणलाल कर्णले थपे, ‘संसदै नचलेको अवस्थामा विधेयक अगाडि बढाउ भनेर मात्रै बढ्दैन । संसद खोल्न भन्दा के हुन्छ ?’

नेकपा एकीकृत समाजवादीका सांसद समिना हुसेनले प्रश्न गरिन्, ‘संसदको अवरोध कायमै राखेर कसरी नागरिकता जस्ता महत्वपूर्ण विधेयकहरु अगाडि बढ्छ ? जनसरोकारको विषय उठाउन नपाइने, कोरोना महामारी लगायत तत्कालका विषय उठाउन नपाइने ? पहिला संसदको ढोका खोल्न पर्‍यो ।’ सभापति पोखरेलले जवाफ फर्काए, ‘माननीयज्यूहरुको भावनासँग सहमत हुन सकियो । तर लिखित गर्न मिलेन ।’

यसरी सिंहदरबारभित्र एमालेलाई नेकपा एकीकृत समाजवादीका सांसदहरुको अस्तित्व स्वीकार्न केही अप्ठ्यारो देखिंदैन ।

बरु सभापति पोखरेलले संसदको अवरोध खोल्नुपर्ने सांसदहरुको भनाइमा भावनात्मक समर्थन जनाए र, समितिबाट निर्णय गराए, ‘नागरिकता विधेयक छिटोभन्दा छिटो अघि बढाउन सरकारलाई निर्देशन दिने ।’

तर, आफैं संसद अवरोध गर्ने, आफैं संसदको बिजनेस अगाडि बढाऊ भन्ने प्रवृत्तिलाई एमाले चरित्रको संज्ञा दिन्छन् नेकपा एकीकृत समाजवादीका प्रमुख सचेतक जीवनराम श्रेष्ठ । ‘एमालेको चरित्र भनेको जनतालाई झुक्याउने हो भन्ने धेरै प्रमाणहरुमध्ये एक हो यो’ श्रेष्ठ भन्छन्, ‘एकातिर संसदलाई बन्धक बनाउने र अर्कोतिर जनता झुक्याउन नागरिकता विधेयक अगाडि बढाऊ भनेर निर्देशन जारी गर्ने । यस्तो चरित्र इतिहासमा विरलै देख्न पाइन्छ ।’

सिंहदरबार सरल, संसदमा उग्र

१ पुस २०७८ मा प्रतिनिधिसभाको विकास तथा प्रविधि समितिको बैठक बस्यो । सरकारका तर्फबाट बैठकमा उपस्थित थिइन्- शहरी विकासमन्त्री रामकुमारी झाँक्री । झाँक्री नेकपा एकीकृत समाजवादीकी सांसद पनि हुन् । उनको उपस्थितिलाई लिएर एमालेका कुनै सांसदले कुनै कोणबाट कुरा उठाएनन् । झाँक्रीले पनि एमाले सांसदहरुको कुरा सुनिन् । दुवैले एक अर्काको अस्तित्व स्वीकार गरेरै छलफलमा सहभागी भए ।

राजनीतिक विश्लेषकहरुको बुझाइमा चुनावसम्मै संसद अवरोध जारी रहन्छ भन्ने एमाले चरित्र संसदीय मर्यादा विपरीत हो । ‘उसले जे भन्यो त्यही हुनलाई एमालेको पेवा हो र संसद ?’ संविधानविद् विपिन अधिकारी भन्छन्, ‘संसदलाई सार्वजनिक हितका लागि प्रयोगमा ल्याउनुपर्छ । यसका लागि एमाले जिम्मेवार हुनुपर्छ ।

’संसद बैठकको एजेण्डा तय गर्ने कार्यव्यवस्था परामर्श समितिको बैठकमा पनि एमालेले एकीकृत समाजवादीका सांसदको उपस्थिति स्वीकार गरेको छ । प्रतिनिधिसभाको कार्यव्यवस्थामा एमालेका तर्फबाट प्रमुख सचेतक विशाल भट्टराई, सचेतक शान्ता चौधरी, सांसदहरू खगराज अधिकारी, शेरबहादुर तामाङ, कृष्णभक्त पोखरेल, लालबहादुर थापा जान्छन् । एकीकृत समाजवादीका प्रमुख सचेतक जीवनराम श्रेष्ठ सहभागी हुन्छन् । राष्ट्रिय सभाको कार्यव्यवस्था परामर्श समितिको बैठकमा एमाले सचेतक खिमलाल भट्टराई र नेकपा (एकीकृत समाजवादी)का ठगेन्द्र प्रकाश पुरी सहभागी हुन्छन् ।

चालु अधिवेशनको पहिलो दिन २८ मंसीरमा बसेको कार्यव्यवस्था परामर्श समितिको बैठकमा नेकपा एकीकृत समाजवादीका प्रमुख सचेतक जीवनराम श्रेष्ठ पहिलोपटक उपस्थित भए । बैठकको शुरुआत गर्दै सभामुखले श्रेष्ठलाई स्वागत गरे ।

एमाले सांसद अधिकारी बीचमै बोले, ‘सम्माननीयज्यू यो बैठकमा हामी को-को छौं ?’ सभामुखले जवाफ फर्काए, ‘कार्यव्यवस्थाकै माननीयहरू र केही आमन्त्रित सदस्यहरू ।’ त्यसपछि एमाले सांसदहरू चुप लागे ।

मंसीर २८ पछिका सबै कार्यव्यवस्था परामर्श समितको बैठकमा एमाले र नेकपा एकीकृत समाजवादी दुवैतर्फका सांसदको सहभागिता छ । र, एकले अर्कोको अस्तित्व स्वीकार गरेको देखिन्छ ।

राष्ट्रिय सभाको कार्यव्यवस्था परामर्श समितिको बैठकमा पनि राष्ट्रियसभाका अध्यक्षले नेकपा एकीकृत समाजवादीका ठगेन्द्र प्रकाश पुरीलाई आमन्त्रित सदस्यका रुपमा सहभागी गराउँदै आएका छन् । यहाँ पनि एमालेले विरोध गरेको छैन ।

कुनै पनि राजनीतिक दलले कार्यव्यवस्था परामर्श समितिमा रहने सांसदहरूको नाम सिफारिस गर्ने र त्यसलाई सदर गरेर संसद बैठकमा सभामुखले सुनाएपछि औपचारिकता पाउने कानूनी व्यवस्था छ । कार्य व्यवस्था परामर्श समितिको बैठकमा रहने नेकपा एकीकृत समाजवादीका सांसदको नाम भने संसदमा सभामुखले पढेर सुनाउन बाँकी छ ।

संसद असफल बनाउने खेल

मिनी संसदको दृश्य संसद भवनमा देखिंदैन । बानेश्वरमा प्रतिनिधिसभाको बैठक शुरु हुने बित्तिकै एमालेका सांसदहरू वेल घेर्न पुग्छन् र नारा लगाउँछन्, ‘सभामुखको व्यवहार मुर्दावाद । गैरसांसदलाई प्रवेश निषेध गर ।’

‘एमालेलाई माधव नेपाल सिंहदरबारमा स्वीकार बानेश्वरमा अस्वीकार किन ? भन्ने प्रश्नमा एमालेका प्रमुख सचेतक विशाल भट्टराई भन्छन्, ‘मिनी संसदमा कसले के भन्यो र के निर्णय भयो भन्ने कुराले स्वीकार गरेको/नगरेको भन्ने हुँदैन । एमालेले उहाँहरूको छुट्टै पार्टी भनेर कतै पनि स्वीकार गरेको छैन।’

सभामुखले र प्रधानमन्त्रीले बोलाएको पटक-पटकको सर्वदलीय बैठकमा एमाले सहभागी नहुनुको कारण नेकपा एकीकृत समाजवादी पार्टीलाई पार्टी मान्न नसकिएकाले हो भन्न हिच्किचाउँदैनन् प्रमुख सचेतक भट्टराई । एकीकृत समाजवादीलाई चुनावअघि नस्वीकार्ने र संसद चल्न नदिने भट्टराईले संकेत गरे । भन्छन्, ‘आगामी चुनावपछिको कुरा अर्कै हो, तर अहिलेलाई उहाँहरूको अस्तित्व स्वीकार गर्न सकिन्न ।’

एमाले अध्यक्ष केपी ओलीले ‘आगामी चुनावसम्मै संसद अवरोध जारी रहन सक्छ’ भनेर दिएको अभिव्यक्तिको सार यही नै भएको भट्टराईको प्रष्टीकरण छ । १० पुस २०७८ मा विराटनगर विमानस्थलमा पत्रकारहरूसँग कुरा गर्दै एमाले अध्यक्ष ओलीले ‘आगामी चुनावअघिसम्म संसद अवरोध गर्ने’ बताएका थिए ।

माधव नेपाल नेतृत्वमा नयाँ पार्टी दर्ता नहुँदै गत भदौमा एमालेले १४ सांसदलाई निष्कासन गरेको थियो । तर सभामुखले त्यसलाई मान्यता नदिएको विरोधमा एमालेले २३ भदौ २०७८ देखि लगातार संसद अवरोध गर्दै आएको छ ।

गैरसंसदीय अभ्यास

एकीकृत समाजवादीका सांसदहरूलाई मिनी संसदमा स्वीकार्ने, तंसदमा अवरोध गर्ने एमालेको द्वैध चरित्र भएको भन्दै आलोचना हुन थालेको छ ।

राजनीतिक विश्लेषकहरूको बुझाइमा चुनावसम्मै संसद अवरोध जारी रहन्छ भन्ने एमाले चरित्र संसदीय मर्यादा विपरीत हो । ‘उसले जे भन्यो त्यही हुनलाई एमालेको पेवा हो र संसद ?’ संविधानविद् विपिन अधिकारी भन्छन्, ‘संसदलाई सार्वजनिक हितका लागि प्रयोगमा ल्याउनुपर्छ । यसका लागि एमाले जिम्मेवार हुनुपर्छ ।’

राजनीतिक विश्लेषक विष्णु दाहाल एमाले जसरी पनि संसद विघटन सही थियो र पुनर्स्थापना गलत थियो भन्ने देखाउने ध्याउन्नमा रहेको बताउँछन् । मिनी संसदमा जाने तर, संसदमा अवरोध गर्ने एमाले चरित्र सांसदहरूको भत्ता र सेवा सुविधासँग पनि जोडिएको बताउँछन् । भन्छन्, ‘संसदीय विषयगत समितिमा गएर नारा लगाउने कुरा भएन । बैठकमै नगए भत्ता आउँदैन । संसदमा त गएर हाजिर लगायो, नाराबाजी गर्‍यो, भत्ता पाकिहाल्छ ।’

बैठक अवरुद्ध गर्ने, तर भत्ता बुझिरहनु अनैतिक काम हुने विश्लेषकहरूको बुझाइ छ । ‘संसद बैठक बस्यो कि बसेन भन्ने हेरर सांसदहरूको सेवा सुविधा तय हुन्छ, संसदले काम गर्‍यो कि गरेन भनेर हेर्ने कुनै मापदण्ड छैन’ विश्लेषक दाहाल भन्छन्, ‘सुविधा कामका लागि हुनुपर्ने हो । तर सुविधा लिन्छ, काम गर्दैन ।’

Election Commission says by May next year. Political parties don’t seem to be prepared.

As the ruling coalition faces a breakdown risk over the parliamentary ratification of the Millennium Challenge Corporation Nepal Compact, an American grant under which Nepal will receive $500 million, there have been talks if the country could head to general elections earlier than the schedule—November-December next year.

CPN-UML, the main opposition, has not hidden its desire to go for polls early. After all, its chair KP Sharma Oli had dissolved the House of Representatives twice—on December 20 last year and May 21 this year. He argued that only a fresh mandate from the people can provide stability to the country. The Supreme Court, however, overturned Oli’s decisions on both occasions.

And then Oli was ousted on July 12 by the Supreme Court which installed Nepali Congress’ Sher Bahadur Deuba as prime minister. Even a year after Oli’s House dissolution move, politics has remained the same in Nepal, failing to move forward.

Deuba is backed by the Communist Party of Nepal (Maoist Centre), the CPN (Unified Socialist), the Janata Samajbadi Party and the Rastriya Janamorcha. The partners have been trying to take the coalition forward at least until the next general elections. Deuba’s push for the MCC, however, has created confusion in the coalition, and speculations are rife that the alliance could fracture. In that case, some believe general elections could happen early.

Amid all the talk about the general elections, no one looks concerned about the local elections.

On May 14, 2017, the country held the first phase of the first local elections in 20 years in 34 districts of three provinces—Bagmati, Gandaki and Karnali.

As many as 13,556 representatives were elected for 283 local governments (municipalities and rural municipalities). In the next five months, their terms will end.

The Election Commission says it needs at least 100 days (a little over three months) to prepare for the polls and the elections must be completed at least 15 days before the incumbent representatives’ terms end.

“The existing local governments can stay until the latest by May 20 next year as per the legal and constitutional provisions,” Dinesh Thapaliya, chief election commissioner, told the Post. “Elections must be held 15 days before the existing representatives’ terms end so that new ones can replace them.”

The government, however, has not communicated to the Election Commission regarding local elections.

The commission’s officials say they are planning to propose local elections by May 3, 2022 if they are to be conducted in a single phase. The commission has sought appointment with Prime Minister Sher Bahadur Deuba to propose the election dates. Thapaliya said they will be meeting him “within a week”.

If the polls are held in two phases, it should start latest by April 28 next year, according to Thapaliya.

Article 225 of the Constitution of Nepal says the term of local governments shall be five years from the date of the election.

As per Clause 55 of the Local Level Election Act, 2016, the terms of local representatives start from the seventh day of the election date. As the first phase of local elections was held on May 14, 2017 the terms of the local representatives are deemed to have begun from May 20. This means new representatives must be elected by then so as to avoid a vacuum.

“The government has a maximum of a month to declare the poll dates because we need 100 days for preparations,” said Thapaliya.

Officials at the commission and constitutional experts say there will be a constitutional crisis if local elections are not held in the next five months.

Even though there are less than six months for the local elections, at least in three provinces, parties have not even said a word.

And many of them, especially from the ruling alliance, do not want the elections by the deadline.

The Communist Party of Nepal (Maoist Centre) and CPN (Unified Socialist) are exploring options to delay the local polls by extending the terms of the existing local governments.

“We are for holding all three levels of elections in one go in November-December next year,” Lila Mani Pokhrel, a standing committee member of the Maoist Centre, told the Post. “The constitution gives room to extend the terms of the existing government by six months.”

Article 225 also says the next local governments shall be elected no later than six months after the expiration of the terms of the existing ones. However, a new Act is necessary to implement the provision which is yet to be drafted by the government.

Officials at the Election Commission don’t see a possibility of the federal parliament bringing a new Act, as there is not enough time to do so. It takes more than a month to endorse a bill in the federal parliament if due process is followed. Another option left with the government is to issue an ordinance.

Leaders from the CPN (Unified Socialist) also say holding elections in May doesn’t look possible, which means the tenure of local governments must be extended.

“I am personally for timely elections but I don’t see it happening,” Jagannath Khatiwada, the party’s spokesperson, told the Post. “I believe the ruling alliance will make its position clear after holding discussions.”

A senior leader from the CPN (Unified Socialist) said as they are busy forming and expanding committees, they are also for postponing the poll date.

“I don’t think any party wants elections in May because they are dealing with their internal issues as they have concluded their general conventions only recently and some of them are planning to hold their conventions soon,” said the leader on the condition of anonymity.

The CPN-UML held its national congress on November 26.

Rastriya Prajatantra Party held its convention on December 1.

The Nepali Congress conducted its general convention from December 10-12. Vote counting for 121 Central Working Committee members is still underway. The Maoist Centre is holding its national conference starting Sunday.

Constitutional experts say elections must be held on time to give momentum to the political process. The government should start focusing on elections, not just for local but provincial and federal also.

Bipin Adhikari, a professor and former dean at Kathmandu University School of Law, said elections will give a new direction to the country as there is a political stalemate—the Parliament has been rendered dysfunctional and the government is hobbling.

“The coalition government has failed to perform. Therefore, the Deuba government should start preparing for polls. It should start with the local polls,” Adhikari told the Post. “As the term of the existing House of Representatives has entered its fifth year, the government can announce dates to elect a new one.”

The elections for the House of Representatives and seven provinces were held in November-December 2017.

The first meeting of the House of Representatives was held on March 5, 2018.

The second and third phases of local elections were held on June 28 and September 18. Officials say the terms of those representatives who were elected from the second and third phases are counted as per those elected during the first phase.

Former election commissioners who oversaw the 2017 elections say there is no alternative to having new elected local representatives by May 20, 2022.

Ayodhee Prasad Yadav, former chief election commissioner, said the government must conduct local elections by the first week of May.

“The existing law doesn’t allow extending the terms of local governments,” Yadav told the Post. “If the government doesn’t want local elections in May, it should put a new law in place to execute Article 225 of the constitution which envisions extending their terms by a maximum of six months.”

12 months after Oli’s House dissolution move: Parliament is deadlocked, judiciary is in crisis and government is hobbling with coalition partners having nothing in common.

Monday marked one year since KP Sharma Oli suddenly dissolved the House of Representatives over infighting within his then Nepal Communist Party (NCP).

A year later, the government leadership has changed, but political confusion continues. The judiciary is in a crisis and the Parliament is deadlocked.

Oli’s House dissolution decision had met with severe criticism for he had taken an unconstitutional move—the constitution does not envision dissolving the Parliament by a majority prime minister.

The parties that sought restoration of the House said Oli had stoked political instability.

But there is uncertainty even today, say observers and analysts. Nepali political parties have failed the country and the people, according to them.

The House that Oli refused to take ownership of ever since he dissolved it—a year ago and again on May 21 this year—is not his priority even today.

His party has been resorting to obstructions.

“Oli is trying to prove his decision to dissolve the House was right so his party is obstructing the proceedings,” said Daman Nath Dhungana, a former Speaker of parliament. “Those who objected to Oli’s decision must unite to save democracy and constitutionalism.”

But what Dhungana says looks more like wishful thinking. Those opposing Oli are now running the government and they seem to have lost the plot.

The current ruling coalition led by the Nepali Congress has the Communist Party of Nepal (Maoist Centre), the CPN (Unified Socialist), the Janata Samajbadi Party and Rastriya Janamorcha as partners.

The coalition is now under threat over the Millennium Challenge Corporation, under which Nepal will receive $500 million from the US in grants. Except for the Congress, all alliance partners are against its ratification from the House.

That apart, political blame-game has continued, with none of the parties trying to address the issues that concern the public.

On Monday, Maoist Centre chair Pushpa Kamal Dahal accused Oli of trying to fish in troubled waters.

“The UML is sending different proposals to the Nepali Congress to split the alliance. Oli is giving feelers that the UML will support the Congress to let it run the government alone if the alliance breaks down,” said Dahal at a function organised by a CPN (Unified Socialist)-affiliated press organisation in Kathmandu . “That’s why it is obstructing the House and refusing to accept the decision of the Election Commission [to register a new party under Madhav Nepal].”

The UML has been obstructing the House, arguing that Speaker Agni Sapkota failed to act on its decision to expel 14 of its lawmakers including Madhav Nepal.

Nepal’s CPN (Unified Socialist) was registered by the Election Commission on August 25.

The next meeting of the House has been scheduled for Tuesday, but the UML has vowed to obstruct the proceedings.

Analysts say the last one year since Oli dissolved the House has been wasted, with governance completely taking a back seat, just as the country stares at an economic crisis and the coronavirus scare.

CK Lal, a political commentator and a columnist for the Post, said that after the Supreme Court restored the House, twice, there was a semblance that the system was back on track.

“But the political process failed to get momentum,” Lal told the Post. “The engine could not function. People thought bringing the system back on track was an achievement, but the country actually has failed to move ahead.”

Lal pointed out a few reasons for the problems facing the country.

“Democracy cannot thrive if the main actors fail to trust each other. This mistrust stems also from the existing constitutional setup, as it is faulty,” Lal told the Post. “It doesn’t create an environment for mutual trust. Oli’s ego—whether in power or in opposition—that he should be at the centre too has created a deadlock.”

Amid the current impasse, some say elections could be the best way forward.

If the current coalition breaks for any reason, there are chances the elections, which otherwise are due next year, could be held earlier.

Pradip Gyawali, deputy general secretary of the UML, said if elections had been held when Oli had called for them after dissolving the House on December 20 last year, political stability would have been restored by now.

According to Gyawali, it is Dahal and some leaders who created instability by stopping Oli from going for the elections.

“Dahal is the source of political instability in Nepal,” said Gyawali who served as foreign minister under Oli when he dissolved the House twice. “He has become a tendency in Nepali politics.”

Some constitutional experts also believe that elections could give a way out to the current political crisis, as the House has become almost ineffective.

“At least four sessions since the Parliament was restored after its first dissolution have failed to accomplish anything, except endorsing the budget. This clearly means that Parliament has failed,” said Bipin Adhikari, a former dean at the Kathmandu School of Law. “The only way left for the parties now is to go to the polls. But the coalition partners don’t want it.”

According to Adhikari, it is better if elections are held early if such a deadlock continues.

But not all agree that elections could fix the problems.

The 2017 elections had given the communists a strong mandate to govern, which many thought would ensure political stability. However, Nepali politicians’ lust for power and self-centred attitude led to the fall of a nearly two-thirds majority government, according to observers.

“What will the country achieve if it goes to elections now?” said Lal, the political commentator. “It will give the same fractured mandate. The distrust among parties remains the same. Politicians do not seem to be committed to the system and the people. Parties have to inspire hope that there indeed is a light at the end of the tunnel.”

काठमाडौँ — सर्वोच्च अदालतमा झैं उच्च र जिल्ला अदालतमा पनि मुद्दाको पेसी गोला प्रणालीबाट तोकिने भएको छ । सर्वोच्च अदालतको पूर्ण बैठक (फुलकोर्ट) ले माघ २ बाट उच्च र जिल्ला अदालतमा गोला प्रणालीबाट पेसी तोक्ने निर्णय गरेको हो ।

फुलकोर्टले उच्च र जिल्ला अदालतमा गोला प्रणालीबाट पेसी तोक्ने व्यवस्था गर्नका लागि आवश्यक तयारी गर्न सर्वोच्च अदालत प्रशासनलाई आदेश पनि दिइसकेको छ । सर्वोच्च अदालतका प्रवक्ता बाबुराम दाहालले गोला प्रणालीका लागि कानुनी तयारी गर्न फुलकोर्टले आदेश दिएको जानकारी दिए । ‘गोला प्रणाली लागू गर्दा आवश्यक पर्ने नियमावलीको संशोधन प्रस्ताव र गोला प्रक्रियाद्वारा पेसी व्यवस्थापनसम्बन्धी निर्देशिकाको मस्यौदा तयार पारेर फुलकोर्टमा पेस गर्न सर्वोच्च अदालत प्रशासनलाई आदेश भएको छ,’ उनले भने । सर्वोच्च अदालत प्रशासनले उच्च अदालत नियमावली, २०७५ र जिल्ला अदालत नियमावली, २०७५ का साथै गोला प्रणाली अपनाउन दुवै तहका अदालतलाई आवश्यक पर्ने निर्देशिकाको मस्यौदा फुलकोर्टमा पेस गर्नेछ । फुलकोर्टले उक्त निर्देशिका पास गरेपछि कानुन, न्याय तथा संसदीय मामिला मन्त्रालयले राजपत्रमा प्रकाशित गर्नेछ । त्यसपछि फुलकोर्टको निर्णयअनुसार माघ २ गतेदेखि उच्च र जिल्ला अदालतमा पनि गोला प्रणालीबाट पेसी तोकिनेछ ।

हाल उच्च अदालतमा मुख्य न्यायाधीशले पेसी तोकिरहेका छन् । जिल्ला अदालतमा भने निश्चित समयभित्र (एक हप्ता, १५ दिन) परेका मुद्दा जिल्ला अदालतमा रहेका न्यायाधीशबीच बाँड्ने गरिन्छ । मुद्दा जुन न्यायाधीशलाई सुरुमा पर्छ, सोही न्यायाधीशले त्यसको फैसला गर्दै आइएको छ । जिल्ला अदालतमा गोला प्रणालीबाट पेसी तोक्दा निश्चित समयभित्र परेका मुद्दालाई न्यायाधीशको संख्याअनुसार विभाजन गरेर गोला प्रणालीद्वारा पेसी तोकिनेछ । त्यसपछि एउटा मुद्दा सुरुमा हेरेको न्यायाधीशकोमा अर्को पटक नपर्न पनि सक्छ । सर्वोच्च अदालतमा मंसिर १५ गतेदेखि नै गोला प्रणालीबाट पेसी तोकिँदै आएको छ । अब पेसी तोक्ने नयाँ व्यवस्था उच्च र जिल्ला अदालतमा पनि लागू गर्न थालिएको हो ।

प्रधानन्यायाधीशको बहिर्गमनको माग गर्दै विरोध प्रदर्शन गरिरहेको नेपाल बार एसोसिएसनले भने उच्च र जिल्ला अदालतमा गोला प्रणालीबाट पेसी तोक्ने निर्णय गर्नु सकारात्मक भएको प्रतिक्रिया दिएको छ । सर्वोच्च अदालत बार एसोसिएसनका अध्यक्ष वरिष्ठ अधिवक्ता पूर्णमान शाक्यले भने यो निर्णयले बार आन्दोलनको बटमलाइनमा यताउति नहुने बताए । ‘उच्च र जिल्ला अदालतमा पनि गोला प्रणालीबाट मुद्दा पेसी तोक्ने फुलकोर्टको निर्णय हाम्रै मागको दबाबमा भएको हो । यसले हाम्रो मागको बटमलाइनमा असर गर्दैन,’ उनले भने, ‘हाम्रो बटमलाइन प्रधानन्यायाधीश चोलेन्द्रशमशेर जबराले बहिर्गमन हुनैपर्छ भन्ने हो, चाहे त्यो महाअभियोग होस् कि राजीनामा ।’

न्याय क्षेत्र सुधारमा प्रधानन्यायाधीश बाधक रहेको भन्दै अध्यक्ष शाक्यले थपे, ‘प्रधानन्यायाधीशको बहिर्गमन वा राजीनामादेखि न्यायालय सुधार अभियानको सुरुवात हुनेछ ।’ न्यायालय सुधारका लागि बारले उठाएका मागहरू संसद्, फुलकोर्ट र बारले पूरा गर्नुपर्ने खालका रहेको उनको भनाइ छ ।

प्रधानन्यायाधीशसम्बन्धी विवादका कारण गोला प्रणालीबाट पेसी तोकिने व्यवस्थाले न्यायालयको सुधार सार्थक रूपमा नहुने संविधानविद् विपिन अधिकारीको भनाइ छ । न्यायालयको नेतृत्व इमानदार नभएको र सबैमा अनुशासनहीनता भएकाले अहिलेको अवस्था आएको उनले बताए । ‘नेतृत्वमाथि पटकपटक गम्भीर प्रश्न उठेको तर समाधान दिन नसकेकाले गोला प्रणाली एउटा विकल्पका रूपमा देखियो । यसले कम्तीमा हिजोभन्दा केही राम्रो होला भन्ने हो ।

उच्च अदालतका मुख्य न्यायाधीश र सर्वोच्च अदालतका प्रधानन्यायाधीश विश्वसनीय मान्छे हुने हो र उपयुक्त व्यक्तिले त्यो पदको पगरी लगाउन पाउने हो भने आफ्नो भूमिका पनि निर्वाह गर्दछ,’ अधिकारीले भने, ‘अहिले कोही पनि अनुशासनमा नभएकाले यो भइरहेको हो । योग्य मान्छे प्रधानन्यायाधीश र मुख्य न्यायाधीश भए भने यो समस्या ठूला अदालतमा हुने छैनन् । विशिष्टतालाई पहिचान गर्दै जाने हो भने गोला प्रणालीलाई नभई न्यायाधीशको व्यक्तित्व, विचार र क्षमतालाई पहिचान गर्नुपर्छ ।’

सर्वोच्च अदालतका न्यायाधीश हरिकृष्ण कार्कीको प्रतिवेदनले पनि न्यायालय सुधारका लागि उच्चदेखि जिल्ला अदालतसम्म गोला प्रणालीबाट पेसी तोक्न सिफारिस गरेको छ । बारले पनि सर्वोच्चदेखि जिल्ला अदालतसम्म गोला प्रणालीबाट पेसी तोक्नुपर्ने माग विरोध प्रदर्शनका क्रममा उठाउँदै आएको छ । ‘उच्च र जिल्ला अदालतमा पनि गोला प्रणालीबाट पेसी तोक्ने निर्णय न्याय प्रशासन शुद्धीकरणका लागि एउटा महत्त्वपूर्ण परिवर्तन हो । न्यायालयको शुद्धीकरण प्रशासन, कानुन व्यवसायीमा पनि आवश्यक छ । न्यायाधीशको सम्पत्ति सार्वजनिक गर्नुपर्ने र कानुन व्यवसायीले कर तिरेको प्रमाण सार्वजनिक गर्नुपर्ने कुरा पनि छन्,’ शाक्यले भने । त्यस्तै जिल्ला अदालतसम्म गोला प्रणालीबाट पेसी तोक्दा न्यायाधीशको कुर्सीमा रहेको व्यक्तिले अनियमिततामा रोक लाग्ने आशा गर्न सकिने अधिकारीको भनाइ छ ।

‘न्यायाधीशहरूको दृष्टिकोणमा राम्रो मुद्दा अरूले लिने नराम्रो हामीलाई दिने भएको हुनाले गोला प्रणाली भयो भने राम्रो, नराम्रो पाउने सम्भावना हुन्छ भन्ने देखियो । यसले कम्तीमा पनि व्यक्तिले गर्ने मोलाहिजा हुँदैन भन्ने दृष्टिकोणसम्मले यो प्रणाली ठीकै होला । तर तार्किक दृष्टिकोण के हो भने निर्णयकर्ता सही हुनुपर्‍यो । न्यायपूर्ण हुनुपर्‍यो । स्वतन्त्र हुनुपर्‍यो । पक्षपाती हुनु भएन । अदालतमा उपलब्ध भएको विज्ञता, क्षमताको कदर हुनुपर्‍यो ।’ विज्ञतालाई ख्याल नगरी अपनाइने प्रणालीले न्याय पद्धतिको आधार बलियो बनाउन नसक्ने उनको भनाइ छ ।

प्रधानन्यायाधीश जबराविरुद्ध न्यायाधीशहरूले इजलास बहिष्कार र बारले विरोध जारी राखेपछि मंसिर १५ देखि सर्वोच्च अदालतमा गोला प्रणालीबाट पहिलो पटक पेसी तोक्न थालिएको हो । प्रधानन्यायाधीशले तोकेको इजलासमा नबस्ने र उनीसँग सँगै इजलास नबस्ने न्यायाधीशहरूको अडान थियो । अहिले पनि जबरा एक्लो परेका छन् । उनी अदालतमा गर्ने कामको निर्णयमा हस्ताक्षर गर्नेबाहेकको भूमिकामा छैनन् । उनले मंसिर सुरुवातदेखि नै मुद्दाको सुनुवाइ गरेका छैनन् ।

बारको अगुवाइमा दिनदिनै सर्वोच्च अदालत प्रांगणमा कानुन व्यवसायीहरूले नाराबाजी जारी राखेका छन् । उनीहरूले प्रधानन्यायाधीश जबराको बहिर्गमन हुनुपर्ने माग राख्दै आएका छन् । न्यायिक विचलन ल्याएको, पेसी तोक्ने क्रममा मनपरी गरेको, न्यायालयमा भ्रष्टाचार र बिचौलियालाई प्रश्रय दिएको, न्यायिक नेतृत्वमा बसेर राजनीतिक सौदाबाजी गरेको भन्दै न्यायाधीश र बार प्रधानन्यायाधीशको विरुद्धमा गएको हो । बारले प्रधानन्यायाधीशको बहिर्गमनबाट पछि नहट्ने अडान लिएर विरोध प्रदर्शन गर्नुका साथै राजनीतिक दलहरूलाई महाअभियोग लगाउन १७ बुँदे अवधारणापत्र बुझाएको छ ।
